NEXA SKIN MED LTD IS THE EXCLUSIVE UK, SCOTLAND & WALES DISTRIBUTOR FOR SELVERT THERMAL BARCELONA. RESALE ON AMAZON, EBAY, ETSY OR SIMILAR MARKETPLACES IS STRICTLY PROHIBITED.

1. Definitions

“Consumer” – An individual acting wholly or mainly outside their trade, business, craft or profession.
“Contract” – A contract for the supply of Products formed under Clause 5.
“Products” – Skincare items supplied by NEXA (excluding those marked “professional use only”).

2. Product Information & Medical Disclaimer

2.1 Product descriptions, INCI lists and directions are provided by the manufacturer and/or our technical team.
2.2 No medical advice: Products are cosmetics only; they are not intended to diagnose, treat, cure or prevent disease.
2.3 Packaging and formulations may change; always check labels before use.
2.4 Customers must review ingredients for allergies, sensitivities or contra-indications and perform a patch test where advised.
2.5 By ordering and/or using Products you acknowledge possible skin reactions and accept that NEXA is not liable for any result arising from failure to follow directions or perform a patch test.

3. Product Information Sources & Optional Consultation

3.1 Official information appears on the packaging and on our website; the packaging prevails if different.
3.2 Optional online consultations may be booked with a NEXA skin specialist (fee applies). These sessions are not medical care and do not include diagnosis or prescriptions.

4. Eligibility & Accounts

You must be 18 years or older to purchase Products and are responsible for all activity under your account.

5. Orders & Contract Formation

5.1 Display of Products is an invitation to treat; your order is an offer.
5.2 A Contract forms only once we accept your order and receive full cleared payment.
5.3 We may decline or cancel orders at our discretion and refund any amounts paid.

6. Prices & Payment

6.1 All prices are in GBP inclusive of VAT as shown at checkout.
6.2 Payment must clear before dispatch. Fraud and security checks may apply.

7. Delivery, Risk & Title

7.1 Delivery options and charges are shown at checkout or in order confirmation.
7.2 Risk and title pass on delivery after payment is received in full.
7.3 Inspect all parcels on receipt and report any damage or shortage within 48 hours with supporting photos.

8. Cancellations & Returns (Distance Sales)

8.1 You may cancel within 14 days of delivery for distance purchases.
8.2 Hygiene exception: Once a seal is broken, returns are not accepted.
8.3 Refunds within 14 days of receipt or proof of return, less deductions for unnecessary handling.

9. Quality & Statutory Remedies

9.1 Products are warranted to match description and be of satisfactory quality on delivery.
9.2 Your statutory rights remain unaffected (Consumer Rights Act 2015).

10. Intellectual Property

All trademarks and other intellectual property remain the property of their owners. Do not use them without written permission.

10A. Resale and Advertising Restrictions

Products purchased from NEXA Skin Med Ltd are for personal or clinic use only and must not be resold, listed, or advertised on marketplaces such as Amazon, eBay, Etsy or similar platforms.
Authorized professional partners may promote products only on their own websites or social media pages without displaying prices publicly. Breach of this clause may result in account termination and refusal of future supply.

11. Limitation of Liability

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Otherwise, our liability is limited to the price paid for the Products.

12. Product Safety & Recalls

You must store and handle Products per label instructions and co-operate with any safety investigation or recall.

13. Data Protection & Privacy

We process personal data as controller under our Privacy and Cookie Policies. You have rights to access, rectify, erase, restrict, port and object.

14. Force Majeure

We are not liable for delay or failure due to events beyond our reasonable control.

15. Changes, Complaints & Governing Law

15.1 We may update these Terms; the version in force at order time applies to that order.

15.3 These Terms are governed by English law; the courts of England & Wales have exclusive jurisdiction, save that consumers resident in Scotland or Northern Ireland may bring proceedings locally.
